Terms and Conditions of Use

1. Parties and Scope

These Terms of Use (the "Agreement") are made between tokatlama.space (the "Operator", "we"), the operator of the website and game service accessible at the tokatlama.space domain (the "Platform"), and the natural or legal person who accesses, views or uses the Platform or creates an account on it (the "User", "you").

This English text is a translation provided for your convenience. The Turkish version of this Agreement is the binding original; in the event of any discrepancy between the two, the Turkish text prevails.

Accessing the Platform, using it, playing the game or creating an account means that you have read and understood this Agreement in full and agree to be bound by all of its provisions. If you do not accept these terms, you should not use the Platform.

This Agreement covers all services offered through the Platform, all in-game features, user accounts and uploaded content. There is no paid service, product or feature on the Platform; the Service is free in its entirety.

2. Definitions

• Platform: the website, the game and all related digital services offered at the tokatlama.space domain and its subdomains.
• Service: the game, character creation, character saving, leaderboard, statistics and all similar functions offered to the User through the Platform.
• User Content: any and all data and material uploaded to the Platform by the User, including photographs, three-dimensional model files, sound recordings, character names and usernames.
• Account: the personal user record the User creates on the Platform by signing in with an e-mail address and password or with a Google account.

3. Subject and Nature of the Service

The Platform offers a browser-based digital game service for entertainment purposes. The game is a humorous arcade game based on collecting points by touching or clicking a three-dimensional character figure.

All characters, figures and images on the Platform are fictional. The game content is in no way intended to encourage violence, hatred, insult or hostility towards real people or any person or group, and may not be interpreted as doing so.

The Service is provided "as is" and "as available". The Operator gives no warranty, express or implied, that the Service will be uninterrupted, error-free or fit for any particular purpose.

The Service is provided entirely free of charge. There is no digital product, subscription or additional feature that can be purchased on the Platform, and no payment is requested from the User under any circumstances.

The Operator reserves the right to change, limit or entirely discontinue the scope, content, game mechanics and features of the Service without prior notice.

4. Membership, Account Security and Age Limit

All game functions of the Platform can be used free of charge without creating an account. An Account is required for personalised features such as saving characters and tracking statistics. Creating an Account is also free.

An Account can be created with an e-mail address and password or by using the "Continue with Google" option. For accounts created with Google, no separate password is held on the Platform; those accounts can only be signed in to through Google.

The User represents and undertakes that the information given when creating an Account is accurate, current and complete. Creating an account with false, misleading or another person's information is prohibited.

The User is solely responsible for keeping the Account password (or the Google account, where Google sign-in is used) confidential and for all activity carried out through the Account. If you notice unauthorised use of your Account, you must notify us immediately at admin@tokatlama.space.

Users under the age of eighteen may use the Platform only with the knowledge and permission of a parent or legal guardian.

It is prohibited for a User to open more than one account in order to manipulate the leaderboard, statistics or reward mechanisms.

5. Rules of Use and Prohibited Conduct

The User agrees to use the Platform only in a manner consistent with the law, morality, public order and this Agreement. The following conduct is expressly prohibited:

• Accessing the Platform with automated scripts (bots), macros, cheat software, auto-clickers or similar tools, or artificially influencing game results.
• Attempting to reverse-engineer, copy or modify the Platform's source code, or producing derivative works from it.
• Attempting to gain unauthorised access to the Platform's infrastructure, servers or database; disrupting the service by sending excessive requests.
• Accessing another User's account without permission or attempting to obtain their credentials.
• Distributing viruses, malware or any code capable of harming systems through the Platform.
• Using the Platform for commercial purposes without the Operator's written permission, or reselling the Service to third parties.
• Attempting to circumvent the Platform's security measures, access restrictions or usage quotas.

In the event of a breach of these rules, the Operator has the right to suspend or permanently close the User's Account without any notice, and to pursue legal remedies for any resulting damage.

6. Content Uploaded by the User

The Platform allows the User to create a personalised character by uploading their own photograph, three-dimensional model file and sound recording. The User is solely and fully responsible for all User Content they upload.

With respect to the content they upload, the User represents, accepts and undertakes that:

• They hold full and unrestricted rights to the uploaded content, or have obtained all permissions necessary to upload it and use it on the Platform.
• The uploaded content does not infringe the copyright, trademark, personality rights, privacy or other rights of third parties.
• A photograph belonging to another person will not be uploaded without that person's express consent.
• The uploaded content contains no insult, hate speech, incitement to violence, obscenity, child abuse, terrorist propaganda or any element constituting a criminal offence.
• The uploaded content is not intended to demean, harass, threaten, bully or target a real person.

With respect to the content they upload, the User grants the Operator a worldwide, royalty-free and non-exclusive right to store, process, display and technically transform that content solely for the purpose of providing the Service. This right ends when the Account or the content is deleted.

The Operator reserves the right to remove, block access to or delete, without prior notice, any User Content it considers unlawful, that is reported as infringing the rights of third parties, or that is found to breach this Agreement. The Operator has no obligation to review content in advance.

If you encounter content you believe infringes your rights, you may report it to admin@tokatlama.space. Reports are reviewed within a reasonable time.

7. Intellectual and Industrial Property Rights

The intellectual and industrial property rights in the software, source code, interface design, logo, trademark, character designs, three-dimensional models, sound effects, texts, images and all other elements on the Platform belong to the Operator or its licensors.

The User is granted only a limited, non-transferable, non-exclusive and revocable right to use the Platform for personal, non-commercial purposes within the scope of this Agreement.

Copying, reproducing, distributing, publishing, renting, selling or creating derivative works from any element of the Platform without the Operator's written permission is prohibited.

Rights in User Content remain with the User; this Agreement does not transfer ownership of User Content to the Operator.

8. No Charge

The Service is entirely free. In-game weapons, ready-made characters, character save slots and every other feature can be used without paying anything.

No payment is collected on the Platform; no credit card, bank transfer, crypto asset or any other payment method is accepted. The Platform never requests payment information from the User under any circumstances.

If anyone requests payment, a wallet address, card details or anything similar from you on behalf of the Platform, that request does not come from the Operator. If you encounter such a situation, please report it to admin@tokatlama.space.

9. Limitation of Liability

The Platform is offered for entertainment purposes, and use of the Service is entirely at the User's own risk.

The Operator is not liable for data loss, loss of progress or indirect damages arising from server outages, maintenance work, internet connection problems, disruptions originating with third-party service providers, cyber attacks or unforeseeable technical faults.

The Operator cannot be held liable for health complaints arising from prolonged screen use, repetitive tapping movements or device-related problems. Users are advised to take regular breaks.

As the Service is provided to the User without any charge, the Operator's liability for damages under this Agreement is limited to the maximum extent permitted by mandatory rules of law.

The limitations in this article do not apply to damages arising from the Operator's intent or gross negligence, or in cases where mandatory rules of law do not permit a limitation of liability.

10. Protection of Personal Data

Acting as data controller under Turkish Law No. 6698 on the Protection of Personal Data ("KVKK"), the Operator processes the User's personal data solely for the purpose of providing the Service.

Categories of data processed: identity information (display name), contact information (e-mail address), transaction security information (hashed password digest), in-game statistics and content uploaded by the User.

If you use the "Continue with Google" option, Google shares with the Operator only your name, your e-mail address, whether your e-mail is verified, and the address of your profile picture. The Operator has no access to your Google account password or its other contents, and this data is used only to create your Account and open your session.

Personal data is processed by automated means in electronic form, on the legal bases of the establishment and performance of the contract, compliance with legal obligations, and the Operator's legitimate interests.

Passwords are never stored in plain text; only irreversible hash values are kept.

Under Article 11 of the KVKK you have the right to learn whether your personal data is processed, to request information if it is, to request its correction or deletion, to object to its processing and to claim compensation for damages. You may send your requests to admin@tokatlama.space.

If you request deletion of your Account, your personal data and the content you uploaded are deleted within a reasonable time, subject to legal retention obligations.

11. Cookies and Third-Party Services

The Platform uses your browser's local storage (localStorage) to maintain your session and remember your preferences. This data is kept only on your device.

The Platform uses Google Analytics to measure visitor statistics anonymously. In this context your IP address, browser and device information and on-site navigation data may be processed by Google.

Google Identity Services (Sign in with Google) is used to open an account or sign in. When you use that button your browser connects to Google's servers and the transaction is subject to Google's own privacy policy. If you do not use this option, you can also open an account with an e-mail address and password.

The Platform's hosting and database infrastructure runs on third-party providers. Those providers' own privacy policies apply.

You can block cookies and local storage from your browser settings; however, some functions of the Platform may then not work correctly.

12. Suspension and Termination of the Service

The Operator may temporarily suspend or permanently terminate the User's access to the Service in cases of breach of this Agreement, unlawful use, security risk or technical necessity.

The User may terminate the Agreement at any time by requesting closure of their Account.

On termination of the Agreement, the provisions that by their nature must remain in force (intellectual property, limitation of liability, applicable law) continue to apply.

13. Force Majeure

Natural disaster, epidemic, war, acts of terrorism, cyber attack, general outages in electricity or internet infrastructure, changes in legal regulation and similar circumstances beyond the Operator's reasonable control are deemed force majeure.

In cases of force majeure the Operator's obligations are suspended until the impediment is removed, and the Operator is not deemed to be in default during that period.

14. Changes to the Agreement

The Operator reserves the right to amend this Agreement unilaterally. The updated text takes effect the moment it is published on the Platform.

Continuing to use the Platform after changes means you accept the updated terms. We therefore recommend that you review this page regularly.

15. Applicable Law and Competent Court

The laws of the Republic of Türkiye apply to the interpretation and application of this Agreement.

The courts and enforcement offices of the Republic of Türkiye have jurisdiction over disputes that may arise between the parties. For Users qualifying as consumers, Consumer Arbitration Committees and Consumer Courts have jurisdiction within the monetary limits set out in the relevant legislation.

If any provision of this Agreement is held invalid or unenforceable, the validity of the remaining provisions is unaffected.

16. Effect and Contact

This Agreement takes effect for an indefinite term the moment the User begins using the Platform.
